Welcome to Evolv Moto LLC (“Evolv Moto,” “we,” “our,” or “us”). By accessing or using our website, purchasing products, or downloading digital content, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our site.

1. Eligibility

You must be at least 13 years old to browse, use, or place orders on this website. By using this site, you confirm that you meet this age requirement.

2. Safety and Legal Notice

Safety is of the utmost importance to us. Helmets and appropriate safety gear must always be worn when riding or using any electric bike, parts, or accessories purchased through our store. Evolv Moto LLC is not responsible for injuries, death, damages, or misuse resulting from improper or unsafe or illegal use of any product.

Parents and Children: Please understand that ebikes are motor vehicles, and each location jurisdiction has its own mandate on appropriate and legal use. Know your child's maturity level. Be involved in their activities. Have the hard conversations with them about safety, and proper and improper use. Teach them the rules of the road where you are. Take the proper steps as a parent to monitor your child's use of their bikes and ebikes to minimize the chances of an accident and injury - or worse. And know the laws where you live and make sure your children also understand these laws before partaking in any riding activities. 

Again - Evolv Moto LLC is not responsible for injuries, death, damages, or misuse resulting from improper or unsafe or illegal use of any product. We want you to have fun and most importantly, be safe.

3. Product Information & Supplier Model

Evolv Moto LLC operates using a dropship model. This means:

  • We partner with multiple third-party suppliers who ship products directly to you.
  • Product availability, specifications, and colors may vary by supplier.
  • Shipping timelines, packaging, and return processes may differ depending on the supplier fulfilling your order.

We make every effort to ensure product information is accurate, but we cannot guarantee that listings are error-free.

4. Pricing

All prices are listed in U.S. dollars. Prices may change at any time without notice. Your order total is the amount displayed at checkout.

5. Orders & Payment

When you place an order, you agree that:

  • All sales are final once payment is processed.
  • Orders cannot be canceled after checkout due to the automated nature of supplier fulfillment.
  • We reserve the right to refuse or cancel orders for suspected fraud or misuse.

6. Shipping & Delivery

Because we work with multiple suppliers:

  • Shipping times vary by product and supplier.
  • Estimated delivery dates are not guaranteed.
  • Evolv Moto LLC is not responsible for delays, supplier backorders, carrier issues, or events outside our control.
  • Some items may ship separately.

You are responsible for providing accurate shipping information. Orders shipped to an incorrect address due to user error cannot be refunded.

7. Returns & Exchanges

Return policies vary by supplier. We aim to offer a 30-day return window where possible, but:

  • The exact return policy for each item is listed on the product page.
  • Some items may not be eligible for return (e.g., used items, installed parts, custom orders, safety equipment).
  • Return shipping costs may apply depending on supplier policy.
  • Refunds, when approved, will be issued once the supplier confirms receipt and condition of the item.

If you receive a damaged or defective product, please contact us at orders@evolvmoto.com within 3 days so we can coordinate with the supplier.

8. Digital Products & E-Guides

E-guides, downloads, and digital files are non-refundable once delivered.

By purchasing digital content, you agree:

  • You receive a non-exclusive, non-transferable license for personal use only.
  • You may not copy, resell, publish, or distribute digital materials.

9. Intellectual Property

All content on this site - including text, graphics, product descriptions, logos, and digital guides - is the exclusive property of Evolv Moto LLC or our partners. Unauthorized use is prohibited and will result in legal action.

10. Limitation of Liability

By using this site and purchasing our products, you acknowledge and agree that:

  • You assume all risk associated with the use or installation of products purchased from Evolv Moto LLC.
  • Evolv Moto LLC is not responsible for accidents, injuries, death, damages, or losses arising from product use, misuse, illegal use, installation, or riding activities.
  • Our liability is limited to the amount paid for the product in question.
